Types of DUIs in Colorado

  • DWAI (driving while ability impaired). This is a slightly lesser version of a DUI. It describes operating a motor vehicle with a BAC between 0.05 percent and 0.08 percent. This is a misdemeanor crime that can come with 2 to 180 days in jail, $200 to $500 in fines and up to 48 hours of community service.

You could also face an aggravated DUI charge in Colorado if you committed a more serious offense while driving impaired. If you caused a car accident, were driving with a minor in the car, were driving with an extremely high BAC or excessively speeding, the charges and penalties will increase.

What Can You Reduce a DUI To?

In Colorado, you may be able to reduce your DUI or DWAI charge to something called a wet reckless. This is especially common among defendants who do not have any prior criminal records. Although a wet reckless is not something you can be criminally charged with in Colorado, it may be available as part of a plea deal.

If offered this plea bargain, you can plead guilty to the lesser charge of wet reckless for reduced penalties. You will be convicted of reckless driving rather than a DUI, and most likely will not face driver’s license suspension. The fines, community service hours and other penalties associated with a wet reckless are generally less than a DUI, as well.
