DMV Hearings

If you were arrested for DUI, your driver’s license was revoked pending the outcome of your case. Recovering your license is a totally separate process from the criminal case against you; you will need to appear at a Colorado Department of Motor Vehicles (DMV) hearing to retain or reinstate your license.

It is important to retain a lawyer to help you do this, as the state will present evidence at this hearing that may also be used against you in the criminal DUI proceedings. The DMV hearing is a preview of the criminal case.

  • Are under 21

  • Refused BAC testing or drove on a commercial driver’s license (CDL) with a BAC of .04 or more

Act Quickly After A DUI/DWAI Arrest

You haveonly seven days from the date of your arrest to request a DMV hearing about your license. Once you have requested a hearing, you will most likely have temporary driving privileges until the date of the hearing. However, your license can still be revoked, depending on the outcome of the DMV hearing. If you do not request a hearing, your license revocation will continue.
